Payment Plan Terms and Conditions
This is an Agreement between you (the inspector) and us (Super Inspector Training Academy - SITA). We are a Texas for-profit corporation and an approved education provider in multiple states, primarily Texas. You want to obtain access to certain parts of Super Inspector Training Academy - SITA’s website, instruction, coaching, intellectual property, and other proprietary resources including, but not limited to, education related to the Home Inspection Industry. In consideration of our willingness to provide access to certain parts of Super Inspector Training Academy - SITA’s website, instruction, coaching, intellectual property, and other proprietary resources, you agree to the terms and conditions below:
Dues. If you become a paying subscriber, you authorize us to charge your credit card or bank account for payment plan fees and other sums you owe us, and to sign any required forms for us to do this. You understand Super Inspector Training Academy - SITA may terminate your payment plan if you do not pay all sums owed when due. You understand Super Inspector Training Academy - SITA will automatically renew your payment plan and charge you for the recurring duration of the payment plan.
Cancellations. If you no longer wish to be a subscriber, you will notify Super Inspector Training Academy - SITA in writing at least 30 days prior to the expiration of your payment plan. If you elect not to renew, you must send your notice to Super Inspector Training Academy - SITA, 7013 S I-35, Corinth, TX 76210 or to the main email contact listed on our contact page.
Cancellations within the first ninety (90) days of enrollment will incur a $200.00 cancellation fee.
Use of Intellectual Property / Benefits. Super Inspector Training Academy - SITA allows its paying subscribers to use some of its logos and other intellectual property as a benefit of their payment plan on such terms as Super Inspector Training Academy - SITA deems appropriate. Those rights terminate when payment plan terminates. All benefits of payment plan terminate when payment plan terminates. Super Inspector Training Academy - SITA may change the terms on which it allows use of its intellectual property and its benefits at any time.
No Guarantees or Warranties. Super Inspector Training Academy - SITA payment plan offers many benefits, including advanced training and customized coaching. However, Super Inspector Training Academy - SITA makes no representations that joining Super Inspector Training Academy - SITA will increase your revenue or generate more clients.
Disputes. Super Inspector Training Academy - SITA strives to improve each day. If you have a complaint or concern arising out of your Super Inspector Training Academy - SITA payment plan, you will promptly email it to us at
SITA@yoursuperinspector.com. Similarly, if you have feedback or suggestions on how Super Inspector Training Academy - SITA can improve, please email suggestions for improvement and/or additional offerings to us at
SITA@yoursuperinspector.com.
Mediation. If you notify Super Inspector Training Academy - SITA of a complaint and we are unable to resolve it, you agree to participate in non-binding mediation with us before filing any action. The mediation will take place in Denton, Texas, and each side will pay 1/2 the mediator’s fees. Super Inspector Training Academy - SITA’s General Counsel will appoint the mediator.
Venue / Waiver of Jury / Attorney’s Fees. The exclusive venue for any dispute arising out of your Super Inspector Training Academy - SITA payment plan shall be in Denton, Texas, unless federal jurisdiction is mandatory, in which case the exclusive venue will be the U.S. District Court in Dallas. In any such action, both parties waive trial by jury. In any such action, the court must award the prevailing party their actual attorney’s fees and costs.
Severability. If a court invalidates any provision of this Agreement, the remaining provisions shall remain in effect.
Not Assignable. You may
not assign your payment plan in Super Inspector Training Academy - SITA. Each subscriber will maintain an independent account; shared accounts will be considered a breach of this agreement and cause for action by Super Inspector Training Academy - SITA.
Waiver. Failure to invoke any right in this Agreement by either party shall not be a waiver of that right.
Governing Law. Texas law governs this Agreement.
Reading / Review of Counsel. You have carefully read this Agreement. You had the opportunity to have qualified counsel review this Agreement before agreeing to it.
Voluntary Agreement. You enter into this Agreement voluntarily, free of any duress.
Entire Agreement. This Agreement contains all representations by Super Inspector Training Academy - SITA to you and expresses the entire understanding between the parties with respect to the transaction at issue. All prior communications are merged into this Agreement, and there are no terms or conditions other than those set forth herein.
Modification. No alleged promise or representation of Super Inspector Training Academy - SITA shall be binding unless reduced to writing and signed by an authorized officer of Super Inspector Training Academy - SITA.
